Rules and Regulations

PSSM is a 501C3 Non Profit Organization.

1. We look carefully for a broad range of products that will enhance the Market experience. The acceptance of each application requires approval of the applicant's merchandise and/or artists' work (this is a family event) by the directors. No payment is processed until an application is accepted.

2. A $200 deposit check is required from each participant in the 2010 market season. This check will be deposited into a savings account. These monies are not applied to any date registrations and will be returned to you at the end of the 2010 season or at your request, after you have successfully completed the dates of participation that your confirmed and paid for. Rain, Snow or Shine, the show will go on, no refunds.

3. Vendor set-up begins at 7a.m., no cars will be allowed into the venue after 9:15 a.m. and all cars must be off the street by 9:30am. You will receive a arrival schedule prior to your participation date.

  • Spaces will be forfeited for the day if you have not arrived at your spot by 9am.
  • Set up and display must be complete by 9:45 a.m.
  • Vendors are required to stay until close of the market at 4pm.

4. Price, terms of sale, bartering etc. are between buyer and seller only. All sellers agree to abide by fair business practices.

5. Vendors may not sell any items not approved of or shown in their market application. Reselling products is especially sensitive and must be approved of in the application process. PSSM has the right to ask vendor to remove products.

6. Tips & Suggestions. Your ultimate goal is to create a 10 x 10 outdoor gallery/boutique. Your display will only add value to your product and it will also be what brings the customer into your booth. Make it different, make it unique, and make it match your personality as an artist. Your patrons are not just buying your work; they're buying a piece of you.

We strongly encourage you to create as strong of a presentation as possible. Decorate your canopy (flame retardant requirements)! Not only do colorful and eye-catching banners/signs add to the visual sense of the market, but research at Markets indicates that vendors whose presentation is organized and whose signage is clear and easy to read, sell more products. 7. Failure to contact the Market (435-655-0994) in the case of an emergency, if you are unable to make the market for any reason or are unable to stay to the end of the day, will result in future denial of your participation in the Market and loss of deposit. NO REFUNDS. We understand that problems arise and everyone cancels for reasons beyond their control. However, please understand there are NO EXCEPTIONS to this rule.

8. All vendors, with the exception of farmers that sell only freshly grown produce and/or plants grown by them, are required to collect sales tax from their customers and remit the sales tax to the Utah State Tax Commission.

  • This is accomplished through a Special Event Sales Tax Form; you cannot remit these taxes on your usual form.
  • Any required sales tax collections and remittances are the sole responsibility of the sellers.
  • If you are accepted into the market and are subject to sales tax collection, the form and/or instructions on how, where and when, will be sent to you by the Utah Special Events State Sales Tax Office. 9. All food vendors are required to be in compliance with Summit County Health Department and/or the Utah Department of Agriculture regulations. Food vendors preparing or sampling on site are required to have a Food Handler's Permit and a Temporary Food Service Permit for Seasonal Events.

  • If you are accepted into the market and are subject to these regulations, you must display both permits in your booth or you will not be allowed to sell food prepared or sampled on site.
  • Food Vendors preparing food with the use of propane and/or electricity must be pre-approved in the application process.
  • On site cooking vendors must supply their own generator for power.
  • Propane cooking equipment must be 5ft from the public and 10ft from a canopy or structure. PSSM has allowed these space requirements in your placement.
  • Cooking areas must be secured from the public with caution tape. Building inspection for canopy structures will take place prior to 10:00 a.m. and the Vendor must be present and available for questions during inspection.
  • On-site cooking food vendors agree to allow Park Silly Sunday Market (5) Complimentary Meal Coupons each Sunday to be used for staff or volunteers of the Market.

Food vendors must provide their own liability insurance and add a rider naming Park Silly Sunday Market and Park City Municipal as additionally insured.

10. All canopies, umbrellas, umbrella stands, weights, tables, chairs, power cords and other logistical items are the sole responsibility of the vendor. Each designated vendor space consists of either one (1) 10 ft. x 10 ft. area of asphalt or of (1) 5 ft. x 8 ft. area of asphalt. An umbrella is acceptable for use in the 5 x 8 ft. space and requires a minimum of a 50 lb stand. Your space rental fee does NOT include a canopy or umbrella. Park City Municipal requires 50 lbs per canopy leg (200 lbs. total) secured to each corner of the canopy. Weight requirements double if you have sides on your canopy. There can be sudden bursts of extreme wind and weather in the mountains. Building inspection for canopy structures will take place prior to 10:00 a.m. and the Vendor must be present and available for questions during inspection. IF YOU DO NOT HAVE THE PROPER WEIGHTS IN PLACE AT THE START OF THE MARKET, YOU WILL NOT BE ALLOWED TO USE YOUR CANOPY.

11. Market Management has the authority to ask any vendors to remove themselves or any product not previously approved by management from the market.

12. Market Management reserves the right to move or reassign vendor locations to enhance or facilitate the market structure and/or safety as deemed necessary.

13. The Park Silly Sunday Market and Park City Municipal Corp. are not liable for any injury, theft or damage to either the buyer or the seller or their property, arising out of or pertaining to preparation for or participation in The Park Silly Sunday Market; whether such injury, theft or damage occurred prior to, during, or after the hours of operation of The Park Silly Sunday Market. Seller further agrees to indemnify and hold harmless both The Park Silly Sunday Market and Park City Municipal Corp for and against any and all claims for such injury, theft and/or damages. Seller assumes full liability for their vehicles, structures, fixtures and the product(s) they market or sell and by participation in The Park Silly Sunday Market hereby agree to hold The Park Silly Sunday Market/or their representatives and/or Park City Municipal Corp. and/or their representatives harmless against any and all claims such as but not limited to injury, theft or damage by any buyer, seller, or other persons resulting from or pertaining to the use, consumption, marketing tactics, display, negligence or disposition of seller's products, vehicles, fixtures or structures. (PSSM does not require this insurance unless you are serving food. It is your decision if you would like this additional protection of your product. If you do not have liability insurance and need some help with this, call Richard Boulder at 435-654-0353 and tell him Park Silly Sunday Market referred you.)

14. The PSSM reserves the right to refuse participation to vendors who do not comply with market rules and regulations or do not meet market standards which include, but are not limited to, following all local, city, state, and federal laws and regulations. Any vendor who the market staff feels is not complying with the market rules may be asked to leave. NO REFUNDS.

15. No refunds. Market will go on rain, shine, wind or snow.

16. Participation in the Market means you accept and agree to a certain degree of silliness, agree to partner with all marketers in creating a fun, friendly, No Trace Left Behind event. Vendors are responsible for removing their own trash from the event and leaving their space spotless. Vendors caught using City receptacles will be subject to a $100 fine and participation in future events may be revoked. No refunds. Vendors may use PSSM receptacles for recycling only. No trash.

17. PSSM Fundraising: To keep our event free to the public and offer continued exciting programming, we are continually looking for fundraising opportunities. We accept donations for water we provide to our patrons and ask that you do not sell any water at the Market. Please email This e-mail address is being protected from spambots. 18. There will be strict enforcement of all Market Rules & Regulations. Market Management reserves the right to refuse acceptance or deny continued participation of any vendor or product that is not in complete compliance with all Market Rules & Regulations.

Commitment to being Silly: In no way will my staff or I antagonize or mistreat another vendor or Festival Patron or Silly Staff during the event. Should this occur I understand that I have waived my rights as a vendor, shall be removed from property and no refund shall be given.

Non Discrimination Policy: The Park Silly Sunday Market prohibits discrimination in all of its programs and activities on the basis of race, color, national origin, age, disability, and where applicable, sex, marital status, familial status, parental status, religion, sexual orientation, genetic information, political beliefs, reprisal, or because all or part of an individual's income is derived from any public assistance program. Park Silly Sunday Market is an apolitical organization and does not allow promotion of any political party of individual within the Market boundaries.
